Terms of Service
Welcome
Radial is a professional cycling social media platform built on the AT Protocol. These Terms, combined with our Community Guidelines, Privacy Policy, and Copyright Policy, govern your use of Radial's application, website, and services.
Key Note: These Terms contain mandatory arbitration provisions and class action waivers. See Section 13 for details.

1. Eligibility
Users must be at least 13 years old and meet minimum age requirements under local law to enter binding agreements.
2. Account Registration and Responsibilities
Account Creation and Security
Users must establish individual accounts. "You are responsible for any use of Radial made through your valid login credentials, including any communications or actions taken through your Account."
Sharing accounts is prohibited. Users alone protect account security and confidentiality. Radial bears no liability for account loss, theft, or fraudulent use.
Content Warranties
By uploading or posting content, users confirm possessing "all rights, licenses, consents, and releases that are necessary for your use of that content and for Radial's use as set forth in these Terms."
Organizational Use
Users representing companies or organizations confirm having authority to do so.
Security Breaches
Report compromised accounts to help@radial.racing immediately.
3. User Content
Content Definitions and Responsibility
"Content" encompasses all shared material: posts, profiles, photos, videos, feedback, suggestions, links, and direct messages.
Users remain "solely responsible for your Content" and agree to comply with all applicable laws and Community Guidelines. Radial doesn't actively monitor or control user content.
Third-Party Usage
Radial doesn't control how others use your content. Report violations through the Complaints and Appeals process.
Radial's Content Usage
The platform uses content only to "operate, provide, and improve Radial and its features, including by sharing it across Radial and the AT Protocol" and to promote and market services.
Content Licensing
Users retain ownership. Radial receives a "limited, worldwide, non-exclusive, royalty-free license" for:
- Operations: Developing, operating, and enhancing Radial, the AT Protocol, and future services
- Adaptation: Reproducing, modifying, adapting, distributing, and publicly displaying content
- Third-Party Tools: Permitting trusted partners like content moderation providers to use content
- Policy Enforcement: Removing, blocking, or modifying content violating Terms or guidelines
"We will never sell your Content without getting your permission first."
Content Deletion
Account deletion triggers "reasonable efforts" to remove content. Radial notifies AT Protocol services of deletion. However, "due to the decentralized nature of the AT Protocol, we cannot control or force other services and Developer Applications on the AT Protocol to treat your Content in a particular way."
4. Content Policy, Moderation, and Illegal Content
Radial prohibits adult and sexually explicit content. While our goal is zero tolerance, the open and decentralized nature of the AT Protocol means such content may occasionally appear before it is removed.
Radial addresses this through two complementary layers:
- Bluesky Moderation Service: Radial relies on Bluesky's AT Protocol moderation infrastructure, which employs automated tools and human review to detect and act on prohibited content—including terrorism content and child sexual exploitation and abuse (CSEA) material—across the AT Protocol network. Moderation actions taken by Bluesky apply to content visible on Radial.
- Radial's Reactive Moderation: Radial operates its own additional moderation layer. Users may report content through in-app reporting tools, and Radial will act promptly on reports of prohibited content.
5. Trending Feeds and Recommender Systems
Radial currently surfaces trending feeds based on engagement across the platform. No personalized recommendations are made at this time. We plan to introduce optional personalized feeds in the future; when available, users will be able to opt out via settings.
Third-party feeds hosted by other services on the AT Protocol are installable. "Radial does not control the recommender systems used by third-party feeds."
6. Complaints and Appeals
Reporting Violations
Users report posts or users through in-app reporting tools or by emailing help@radial.racing. Radial "will promptly notify users when we take enforcement action in response to a report."
Non-users legally entitled to submit reports should contact help@radial.racing.
Appeals Process
Suspended, terminated, or restricted accounts may appeal by emailing help@radial.racing. Appeals require supporting documentation and must be filed within two weeks of the account suspension, termination, or restriction you seek to appeal.
Radial notifies users upon appeal review completion.
EU/EEA Appeals
Residents can challenge decisions through:
- Internal Appeal: Emailing help@radial.racing
- Out-of-Court Dispute: Using certified DSA bodies with appropriate expertise (non-binding)
- Judicial Remedy: National courts
Information about certified bodies appears via national Digital Services Coordinators and EU Commission's public list.
7. Termination
User Termination Rights
Users may "terminate your Account at any time by using the account deletion option in your settings." Radial retains personal data per Privacy Policy and "only as necessary for trust and safety, legal compliance, or other legitimate purposes."
Radial Termination Rights
The platform may "suspend, restrict, or terminate your Account—or specific features of Radial—at any time, without prior notice" if:
- Terms, Privacy Policy, Community Guidelines, or Copyright Policy violations occur
- Legal requirements mandate suspension
- "your continued access poses a risk to Radial, to other users, or to third parties"
8. Third-Party Services
Radial is built on the AT Protocol and integrates closely with Bluesky's infrastructure. Specifically:
- Direct Messages are delivered via Bluesky's messaging service and stored on Bluesky's servers. Bluesky's Terms of Service and Privacy Policy govern the storage and handling of your direct messages.
- Moderation relies in part on Bluesky's moderation service (see Section 4).
Radial may also provide access to other third-party websites, services, or resources. Such references aren't endorsements. "We do not control, verify, or assume responsibility for the content, policies, or practices of third-party sites or services." Users bear full responsibility reviewing and complying with third-party terms and policies.
9. Open Source Software
Components are "licensed under open source terms, including the MIT and Apache licenses." Usage follows respective license terms maintained by overseeing organizations.
Users must review and comply with applicable open source licenses.
10. Warranty Disclaimer
General Disclaimers
"Radial and all Content and services provided through it are offered on an 'as is' and 'as available' basis, without warranties of any kind—express, implied, or statutory."
Radial "expressly disclaim[s] all warranties, including:" implied merchantability, fitness, non-infringement, and course-of-dealing warranties. The platform makes "no guarantee that Radial will be uninterrupted, timely, secure, error-free."
Third-Party Content
"WE MAKE NO REPRESENTATIONS OR WARRANTIES–AND ACCEPT NO RESPONSIBILITY–FOR ANY THIRD-PARTY CONTENT, DEVELOPER APPLICATIONS, OR OTHER PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES."
User Content Disclaimer
Radial bears no responsibility for user-shared or transmitted content. Users understand encountering "Content that is inaccurate, misleading, offensive, inappropriate, untimely, or otherwise objectionable."
Scope Limitations
Disclaimers apply "to the maximum extent permitted by applicable law."
11. Indemnification
Users agree to "indemnify, defend, and hold harmless Radial, its affiliates, and their respective officers, directors, employees, and agents" from claims, disputes, liabilities, damages, and expenses—including attorney and accounting fees—arising from:
- Radial access or use
- User content
- Terms or policy violations
- Actions through services
- Law or third-party rights violations
Radial reserves exclusive defense and control rights. Users must cooperate fully.
12. Limitation of Liability
Excluded Damages
"Radial and its affiliates will not be liable for" indirect, special, incidental, punitive, or consequential damages including lost profits, business interruption, or data loss. Substitute service costs and third-party claims are expressly excluded.
Exceptions
Exclusions don't apply to death or personal injury claims based on:
- Radial fraud or criminal misconduct
- Gross negligence or willful misconduct
- Statutory rights that cannot be contractually disclaimed
Monetary Cap
Except for excepted claims, "Radial's total cumulative liability for all claims arising out of or related to these Terms—whether in contract, tort, statute, or otherwise—is limited to one hundred U.S. dollars (US$100)."
Scope and Validity
Limitations apply "to the maximum extent allowed by law."
13. Governing Law, Jurisdiction, Venue, Dispute Resolution, and Arbitration
Applicable Law
"These Terms and any disputes or claims arising out of or relating to them (including non-contractual disputes) are governed by the Federal Arbitration Act, applicable federal arbitration law, and the laws of the State of Idaho."
Jurisdiction and Venue
Non-arbitration legal actions must proceed "exclusively in the state or federal courts located in Idaho." Parties consent to jurisdiction and venue, waiving forum objections.
Local Law Exception
Jurisdictions requiring application of local laws, courts, or mandatory procedures override Idaho provisions "to the extent required by applicable law."
Dispute Resolution Process
Informal Resolution
Parties must resolve disputes informally before litigation. Contact help@radial.racing with:
- Full name and email
- Jurisdiction (city, state, province, or county)
- Account handle
- Specific damages or relief amount sought
- Supporting evidence
- Arbitration intention statement
"after you submit your informal resolution request, you will participate with us via telephone or videoconference, in a good-faith effort to resolve the dispute informally."
Statute of limitations and filing deadlines toll during informal resolution.
Mandatory Arbitration
If informal resolution fails, disputes "will be resolved...through final and binding arbitration by AAA (U.S.) or ICDR (UK/EU), seated in the county (or parish) where you live."
"Each party shall select one arbitrator; the pair appoint a third."
AAA Rules govern at www.adr.org (1-800-778-7879). Submit written Demand for Arbitration to AAA with Radial notice per AAA Rules.
AAA fee rules apply. If Radial prevails, parties don't recover attorney fees unless claims were frivolous. Prevailing users receive attorney fees and expenses per applicable law.
Safety Claims Carve-Out
"Arbitration does not apply to claims that fraud, criminal misconduct, or gross negligence by Radial caused death or personal injury." Such matters proceed in court or arbitration per claimant choice.
Class Action Waiver
"YOU AND RADIAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING."
If unenforceable, Section 13.D becomes void entirely. However, "Nothing in this section shall prohibit the AAA's consolidation of the administration of multiple claims."
Radial Consolidation Discretion
"Radial may, at its sole discretion, elect to consolidate multiple arbitrations involving similar issues or claimants into a single consolidated arbitration" per AAA rules.
Small Claims and Injunctive Relief
Eligibility for small claims court proceedings isn't restricted. The clause doesn't waive statutory rights under country-of-residence law.
Public injunctive relief claims litigate in civil court, not arbitration. Parties agree litigation stays pending arbitration merits completion.
Survival
This Section survives account termination.
14. Updates to Terms
"We may update these Terms periodically. We will always post the revised version here and we will notify you through the App, website, or other communication channel if we make any material changes."
Regular review is user responsibility. "By continuing to use Radial after any update, you agree to the revised Terms." Disagreement requires discontinuing use.
15. Intellectual Property
All non-open-source rights belong to Radial. "We reserve all rights not expressly granted to you in these Terms." The platform receives protection through trademark, copyright, patent, and other laws.
"Except for the parts of Radial that are licensed under open source terms, we own all applicable rights, title, interest in and to Radial."
Use is "subject to these Terms, and, unless explicitly provided, these Terms do not grant you any rights to our Intellectual Property Rights or the Intellectual Property Rights of our licensors, licensees, or partners."
Intellectual Property Rights include all patent, copyright, mask work, moral, publicity, trademark, service mark rights, goodwill, trade secrets, and future intellectual property under any jurisdiction's laws, including applications, registrations, renewals, and extensions.
16. General Terms
Complete Agreement
"These Terms, together with the Radial Community Guidelines, Privacy Policy, and Copyright Policy, constitute the complete and exclusive agreement between you and Radial."
They supersede "any prior or contemporaneous agreements, understandings, or communications—whether oral or written."
Invalid or unenforceable provisions are "enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect."
Severability
"If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision will be severed from these Terms, and the remainder will continue in full force and effect."
Notices
Radial provides notices through "posting them in the Radial App or on our website, or by sending them by email or other communication methods based on the information associated with your account."
Users "agree to receive communications from us electronically and acknowledge that all electronic communications satisfy any legal requirement for a written communication."
Waiver
"Our failure to enforce any provision of these Terms is not a waiver of our rights to enforce it later." Waivers require written authorization from Radial representatives. "The exercise of one right does not waive other rights or remedies unless explicitly stated."
Interpretation
Terms are "interpreted fairly and without bias to either party." Terms "including," "includes," "such as," and "for example" mean "without limitation."
Italicized summaries "are provided for convenience and ease of navigation only. They do not have any legal effect." Upon conflict, "the full text will govern."

18. Apple App Store and Google Play Required Terms
Additional terms apply to App Provider downloads:
- "These Terms are between you and Radial—not the App Provider." App Providers bear no responsibility.
- Radial solely handles "any claims, losses, liabilities, or expenses arising from its failure to meet any applicable warranties." Warranty non-conformance notification proceeds through App Providers with "no further warranty obligations."
- App Providers provide no "maintenance or support services for the App."
- App Providers aren't responsible for claims "including product liability, legal compliance, or intellectual property infringement."
- Third-party intellectual property claims rest exclusively with Radial per Terms.
- "The App Provider and its affiliates are third-party beneficiaries of these Terms and may enforce them accordingly."
- Users must "comply with all applicable third-party terms of service when using the Radial App."
